Privacy Policy

As freedom-loving individuals, data protection naturally holds a special significance for us. Protecting your data is therefore a top priority. We only collect the essential data, handle it with care, and will never sell it to third parties. Please note that this privacy policy is still under development and is not yet fully valid!

Privacy Policy

Using our club pages is generally possible without providing any personal data. However, if you want to actively participate in club life, storing personal data becomes practically unavoidable. If storing and processing this personal data is necessary and there is no legal basis for such processing, we will always obtain your consent beforehand. By using our services, you agree to this privacy policy.

Responsibility

The company named in the provider identification ("Provider") is responsible for storing, using, processing, any possible sharing, and protecting your personal data. (hereinafter referred to as Photoclub)

Data Collection and Usage

Without Registration

Photoclub collects general data and information with every website visit, such as browser type, operating system, referrer, subpages accessed on Photoclub, date and time of access, IP address, ISP, and other similar data that can help defend against cyberattacks on Photoclub. We do not draw any conclusions about the individual from this data. This information is used solely to deliver our content correctly, optimize our advertising, ensure the functionality of our systems, and provide law enforcement with necessary information in case of an attack on our systems. These anonymously collected data are analyzed to enhance data protection and security within Photoclub. The anonymous server log data are stored separately from any personal data provided by an individual.

With Registration

You have the option to register as a member of Photoclub by providing personal data (name, email). Additionally, you can personalize your member profile with further personal information (username, date of birth, place of residence, profile details). Your photos, including Exif data, comments, and forum posts, are also stored.

This personal data is collected and stored exclusively for internal use within Photoclub and for our own purposes. Photoclub may share this data with one or more service providers, such as payment processors, who also use it solely for internal purposes.

When you register, your IP address, date, and time of registration are stored. This is necessary to prevent misuse of our services and to enable the investigation of possible criminal offenses. Therefore, storing this data is required. We do not share this data with third parties unless legally obligated or if the data is needed for law enforcement purposes.

Unless legal retention obligations apply, registered members can request to modify, delete, or correct their personal data at any time. You can also view your personal data anytime via your member profile.

Contact Options

If you contact us via email, a contact form, or the support ticket system, the personal data you provide will be automatically stored. Data voluntarily submitted to us will be used to process your inquiry, maintain further contact, and serve as legal evidence if necessary. Personal data will only be shared with third parties if absolutely necessary to clarify legal matters.

Paid Services

Registered members have the option to purchase a premium membership. For premium memberships, it is necessary to provide additional personal data such as address and payment information to fulfill the contract and provide the agreed services. These data are linked to your member account and stored together. As long as an active contract or outstanding claim exists, these linked data cannot be deleted because, as mentioned above, they are necessary for contract fulfillment. After the contract is fully completed and terminated, we are legally required to retain the data for 10 years.

Notifications and Newsletters

Many contents published on Photoclub can be subscribed to. For example, you will be notified immediately when a new comment is made on your photos. If you choose to subscribe to these options, our system will automatically send notifications about updates. You can unsubscribe from content subscriptions at any time in your settings.

Additionally, we send personalized newsletters to make your Photoclub experience even more engaging. We deliberately do not use any external email providers. All your data remains securely stored in our system. Using such a service would mean sharing your data with third parties, which we do not want.

Cookies

Photoclub uses cookies. Only by using cookies can we provide you with a user-friendly service that would not be possible otherwise. Without cookies, for example, you would have to log in again after every page change. We also use cookies to collect usage statistics to continuously improve our service for members. Our cookies store information such as language settings, login status, search terms used, user preferences, and usage statistics.

Cookies contain only text information; they cannot execute programs or transmit viruses. Cookies are stored on your device and transmitted to our system. You can prevent cookies from being set at any time by adjusting your browser settings, thereby permanently objecting to their use. You can also delete cookies already set via your browser or other software. This works in all common browsers. However, if you disable cookies, you will no longer be able to fully use Photoclub.

Facebook

We want to explicitly point out that Facebook has now committed to and been certified under the EU-US Privacy Shield agreement. Therefore, Facebook is now also obliged to strictly comply with European data protection standards and regulations.

To enhance the user experience on Photoclub, we have integrated some Facebook components on certain pages. Facebook is operated by Facebook, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. For data processing outside the USA or Canada, the responsible entity is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Photoclub uses a Facebook feature called "Facebook Connect." This allows you to quickly and easily register with us. "Facebook Connect" automatically establishes a direct connection between your browser and Facebook’s server during registration or login. You are redirected to Facebook, where you can log in with your Facebook credentials, linking your Facebook account with your Photoclub account.

When you visit a page with an integrated Facebook plugin, your browser is prompted to load and display the Facebook component. During this process, Facebook learns which subpage you visited. Don’t worry—if you are not logged into Facebook, this data remains anonymous. You can also easily prevent this data transmission (see below).

If you are logged into Facebook, Facebook recognizes which specific subpage you visit with each page load. This information can then be linked to your Facebook account. For example, if you share our content on Facebook, Facebook associates this with your personal account. Facebook receives this information whenever you visit our site while logged into Facebook, regardless of whether you interact with the Facebook component. To prevent this data transmission, simply log out of your Facebook account and clear your cookies before visiting Photoclub.

Facebook’s data policy, available at https://de-de.facebook.com/about/privacy/, explains how Facebook collects, processes, and uses personal data and what privacy settings are available. There are also various programs and browser extensions to block data transmission to Facebook.

Google Analytics (with Anonymization Feature)

Photoclub uses Google Analytics (with anonymization) — referred to as GA — to analyze website usage and continuously improve our offerings. GA is a web analytics service by Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA. GA collects data about visitor behavior on Photoclub, such as the referring website, pages visited, frequency, and duration. These anonymous statistics are mainly used to optimize our website and analyze the cost-effectiveness of our online advertising.

We use the "_gat._anonymizeIp" extension, which shortens and anonymizes your IP address if your access is from the EU. Google Analytics sets a cookie on your device for this purpose.

You can prevent cookies from being set as described above by adjusting your browser settings, thereby objecting to cookie use permanently. Google’s privacy policies are available at https://www.google.de/intl/de/policies/privacy/ and http://www.google.com/analytics/terms/de.html.
